THIS NOTICE DESCRIBES HOW HEALTH INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Notice applies to protected health information maintained by GreenNvy Niche, PLLC in connection with healthcare services provided by the practice.

Your Rights
When it comes to your health information, you have certain rights.
Obtain a Copy of Your Health Information
You may request to inspect or receive an electronic or paper copy of health information GreenNvy maintains about you, subject to applicable federal and Texas law.
In most circumstances, GreenNvy will provide the requested information or a summary within the timeframe required by law. A reasonable, cost-based fee may apply when permitted.
Certain mental-health records may be subject to additional protections or limitations under Texas law.
Ask Us to Correct Your Record
You may request that GreenNvy correct health information you believe is inaccurate or incomplete.
GreenNvy may deny certain requests when permitted by law. If a request is denied, you will be provided an explanation as required by applicable law.
Request Confidential Communications
You may ask GreenNvy to communicate with you in a particular way or through a particular method.
GreenNvy will accommodate reasonable requests as required by applicable law.
Ask Us to Limit What We Use or Share
You may ask GreenNvy not to use or disclose certain health information for treatment, payment, or healthcare operations.
GreenNvy is not always required to agree to such requests.
If you pay for a healthcare service entirely out of pocket, you may request that information concerning that service not be disclosed to your health plan for payment or healthcare operations. GreenNvy will honor the request unless disclosure is required by law.
Obtain an Accounting of Certain Disclosures
You may request information about certain disclosures GreenNvy has made of your health information.
The accounting generally covers the six years preceding your request and does not include certain disclosures excluded by law, including many disclosures made for treatment, payment, healthcare operations, or disclosures you specifically authorized.
GreenNvy will provide one accounting within a 12-month period without charge. A reasonable, cost-based fee may apply to additional requests when permitted by law.

Choose Someone to Act for You
If you have given another person legal authority to act on your behalf, such as through a medical power of attorney, guardianship, or other legally recognized authority, that person may exercise certain privacy rights for you.
GreenNvy may verify that person's authority before taking action.
File a Privacy Complaint
If you believe your privacy rights have been violated, you may file a complaint directly with GreenNvy by contacting:

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.
GreenNvy will not retaliate against you for filing a privacy complaint.
Your Choices
For certain health information, you may tell GreenNvy your preferences regarding what information is shared.
When applicable, this may include sharing information with family members, friends, or others involved in your care.
If you are unable to communicate your preference—for example, during an emergency—GreenNvy may disclose information when legally permitted and when professional judgment indicates that doing so is in your best interest.
GreenNvy will obtain your written authorization for uses or disclosures requiring authorization under applicable law.
GreenNvy does not sell your protected health information.
How GreenNvy May Use and Disclose Your Health Information
Treatment
GreenNvy may use your health information to provide, coordinate, or manage your treatment and may share information with other healthcare professionals involved in your care when permitted by applicable law.
Because mental-health records receive additional protection under Texas law, GreenNvy will apply applicable state confidentiality requirements when determining whether information may be disclosed.
Healthcare Operations
GreenNvy may use or disclose health information as permitted to operate the practice and provide appropriate services.
Examples may include quality assessment, clinical consultation when legally permissible, administrative activities, credentialing, compliance activities, and practice management.
Reasonable safeguards will be used to protect your privacy.
Payment
GreenNvy may use and disclose health information as necessary to obtain payment for services, including submitting information to health plans, billing services, or other entities involved in payment when applicable and legally permissible.
Business Associates
GreenNvy may use third-party service providers that perform functions involving protected health information on behalf of the practice.
When HIPAA requires it, GreenNvy will maintain appropriate Business Associate Agreements requiring those entities to safeguard protected health information.
When Required or Permitted by Law
GreenNvy may disclose health information when federal or state law requires or permits disclosure.
Depending upon the circumstances, this may include certain disclosures concerning suspected abuse or neglect, serious threats to health or safety, public-health activities, health oversight activities, workers' compensation matters, certain law-enforcement or governmental requests, judicial or administrative proceedings when legally authorized, medical examiners or other legally authorized persons, and other circumstances required or permitted by applicable law.
The existence of a legal exception permitting disclosure does not necessarily mean GreenNvy will disclose information in every circumstance. Applicable professional, ethical, state, and federal requirements will be considered.
Special Protection for Mental-Health Information
Mental-health information receives significant confidentiality protection under Texas law.
Communications between a patient and a mental-health professional, as well as records concerning a patient's identity, diagnosis, evaluation, or treatment of a mental or emotional condition, are confidential except when disclosure is authorized or permitted by applicable law.
When Texas law provides greater privacy protection than federal law, GreenNvy will follow the more protective applicable requirement.
Psychotherapy Notes
Psychotherapy notes, when maintained separately and meeting the applicable legal definition, receive additional protection.
In most circumstances, GreenNvy must obtain your written authorization before using or disclosing psychotherapy notes except for limited uses or disclosures permitted by law.
Psychotherapy notes are distinct from the clinical record ordinarily maintained for treatment.
Substance Use Disorder Records
Certain substance-use-disorder records may receive additional protection under federal law, including 42 C.F.R. Part 2.
To the extent GreenNvy creates, receives, or maintains records subject to 42 C.F.R. Part 2, those records will be used and disclosed in accordance with applicable Part 2 requirements.
Marketing and Sale of Information
GreenNvy will obtain authorization before using or disclosing protected health information for purposes requiring authorization under HIPAA.
GreenNvy does not sell protected health information.
Our Responsibilities
GreenNvy is required by law to maintain the privacy and security of protected health information; provide you with notice of its legal duties and privacy practices; follow the privacy practices described in the Notice currently in effect; notify affected individuals as required if a breach occurs that may have compromised their protected health information; and provide additional privacy protections when required by applicable federal or Texas law.
GreenNvy will not use or disclose your information in a manner not described in this Notice unless you provide written authorization or the use or disclosure is otherwise permitted or required by law.
If you provide authorization, you may revoke it in writing as permitted by law. Revocation generally will not affect actions already taken in reliance on a valid authorization.
Changes to This Notice
GreenNvy may change the terms of this Notice.
Changes may apply to health information GreenNvy already maintains as well as information received or created in the future.
When material changes are made, an updated Notice will be made available as required by law and posted on GreenNvy's website.
